Karta, coparceners, members — who is who

Coparceners hold a birthright and can demand partition; the karta manages; those who married in have maintenance rights. Daughters are equal since 2005.

Your grandfather's house is in the family's name. Who can force it to be split, who only gets to live in it, and who signs the papers? Three words decide, and they are not interchangeable.

COPARCENERS are born into the family and hold a birthright in its property — they can demand partition. The KARTA, usually the senior-most coparcener, manages everything: the bank account, the property, the tax return. MEMBERS, like spouses who married in, are entitled to be maintained from family property, but cannot demand partition.
