Lesson 3 of 3 · 5 min
When it is family asking
Most guarantees in India are agreed across a dining table rather than at a bank counter — and the two questions in that room are worth separating.
The part that is not in the Act

Kabirasking
Everyone at home already knows he asked me. If I say no, it becomes a story about me for the next ten years. Where does section 128 help with that?
Taraexplaining
It does not, and I am not going to pretend otherwise. What it does is separate two questions that get mashed into one in that room.
Kabirasking
Which two?
Taraexplaining
Whether you believe he repays — that question is about him. And whether you could carry the outstanding amount if he did not — that one is only about you. Section 128 is why the second one says the outstanding amount and not a portion.
Kabirasking
And if the honest answer to the second one is no?
Taraexplaining
Then that is a fact about your bank balance, not a verdict on your uncle. Some people say exactly that out loud. Some ask to read the loan papers first. Some sign anyway, with their eyes open. All three of those happen every day.
What is the paper in front of me?
What does the document say your role is?

If a loan you guaranteed went unpaid tomorrow and the outstanding amount landed on you, what in your own month would have to give way? Write it down for yourself — this note stays in your browser and goes nowhere else.
